Fifth Circuit Upholds at Home Distilling

Big News: Fifth Circuit Clears Path for At-Home Distilling

Huge news for the distilling community.

The United States Court of Appeals for the Fifth Circuit has affirmed that the federal ban on at-home distilling is unconstitutional—a decision that marks the biggest shift for hobby distillers in modern history.

What Happened

For over 150 years, federal law banned distilling spirits at home—no matter how small-scale or responsible the setup.

The court has now ruled that:

  • The federal government cannot ban distilling simply to make taxation easier
  • The law actually prevented taxable spirits from being produced at all

That’s a major change in how the law treats distillers.

What This Means for Brewhaus Customers

Let’s be clear—this is a big step forward, but it’s not a free-for-all.

What’s changed:

  • The federal government can no longer prohibit distilling based on location
  • This opens the door for TTB-permitted distilling operations at home

What has NOT changed:

  • You still need a federal permit from the TTB
  • You must follow all federal regulations
  • You must pay excise taxes on spirits produced
  • You must comply with state and local laws

Bottom line:
This removes a major barrier—but the permitting and regulatory system still applies.

Why This Matters

This decision moves distilling closer to where homebrewing and winemaking have been for years:

  • Legal pathways
  • Clear regulations
  • Room for innovation and craftsmanship

For many of our customers, this is the moment you’ve been waiting for.

What Comes Next

There’s still work ahead:

  • Federal agencies may respond or appeal
  • Rules and permitting pathways may evolve
  • State laws will continue to play a major role

At Brewhaus, we’ll be watching closely and keeping you informed every step of the way.

Final Thoughts

This is the strongest signal yet that the future of hobby distilling is changing—for the better.

The door is opening.

Now it’s about doing it right.
